These Terms of Service ("Terms") govern your access to and use of the Website and all services, features, and content offered through it (collectively, the "Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Description of Service
DigiBouquet is a free, browser-based digital flower bouquet creation tool. The Service allows users to:
- Select from a curated collection of AI-generated flower and foliage images to compose a digital bouquet
- Choose card templates, background themes, and visual styles for their arrangement
- Personalize bouquets with custom recipient names, sender names, and free-form messages
- Generate a unique shareable URL that encodes their bouquet configuration
- View bouquets created by others via shared links
The Service is provided as a purely static web application. No user accounts, databases, or server-side data storage are used in connection with the core bouquet creation and sharing features. All bouquet data is encoded within the shareable URL itself using Base64 encoding.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
3. Acceptable Use
By using the Service, you agree to use it only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Service. You agree not to:
- Use the Service to transmit, distribute, or store content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
- Use the Service to create bouquets with messages that constitute hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
- Attempt to gain unauthorized access to any portion of the Service, its related systems, or networks connected to the Service
- Use automated scripts, bots, scrapers, or other automated means to access the Service in a manner that exceeds reasonable personal use
- Attempt to interfere with or disrupt the integrity or performance of the Service or the data contained therein
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices from any portion of the Service
- Use the Service in any manner that could damage, disable, overburden, or impair the Service or servers or networks connected to the Service
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service (except to the extent permitted by applicable law)
- Use the Service to send unsolicited communications (spam) to others
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these acceptable use provisions, including suspending or terminating their access to the Service.
4. Intellectual Property
The Service and its original content, features, and functionality (including but not limited to the website design, layout, user interface, code, graphics, and all AI-generated flower and foliage images) are owned by DigiBouquet and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
AI-Generated Images: All flower, petal, and foliage images displayed on the Website are generated using artificial intelligence technology. These AI-generated images are provided for your use in creating digital bouquets through the Service. While we do not assert traditional copyright over these AI-generated images, you may not download, redistribute, or use them outside of the Service in any commercial context without our prior written consent.
DigiBouquet Brand: The DigiBouquet name, logo, and associated brand elements are proprietary to DigiBouquet. You may not use our brand elements without our express written permission. Any permitted use must comply with our brand guidelines as provided from time to time.
User Content: You retain ownership of the text content (names, messages) you create through the Service. By using the Service, you grant DigiBouquet a non-exclusive, worldwide, royalty-free license to process and encode this content as part of generating your shareable bouquet URLs. We do not store, analyze, or use your personal content for any other purpose.
Open Source Components: The Service may incorporate open-source software components governed by their own licenses. Nothing in these Terms limits your rights under, or grants you rights that supersede, the applicable open-source license terms.
5. User-Generated Content
The Service allows you to input text content including recipient names, sender names, and personal messages ("User Content"). Because all User Content is encoded within the shareable URL and not transmitted to or stored on our servers, you bear sole responsibility for all User Content you create and share through the Service.
By creating User Content through the Service, you represent and warrant that:
- You have all necessary rights, licenses, consents, and permissions to create and share the User Content
- Your User Content does not violate any third party's intellectual property rights, privacy rights, publicity rights, or other legal rights
- Your User Content does not contain any viruses, malware, or other harmful code
- Your User Content complies with all applicable laws and regulations
You acknowledge that once you share a bouquet link, the User Content encoded within it (including names and messages) is accessible to anyone who receives and opens the link. You are solely responsible for deciding with whom you share your bouquet links and for any consequences that arise from sharing such content.
We do not monitor, review, or screen User Content created through the Service. However, we reserve the right to investigate any reported misuse of the Service and take appropriate action in accordance with these Terms.
6. Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect information in connection with the Service. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
As noted above, DigiBouquet does not collect or store the personal content (names and messages) that you include in your digital bouquets. This content exists solely within the URLs you generate and share. We do use third-party analytics services (specifically Google Analytics) to collect anonymized usage data to help us improve the Service. 7. Disclaimers and Limitation of Liability
Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIGIBOUQUET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that (a) the Service will function uninterrupted, securely, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements or expectations.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIGIBOUQUET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your access to or use of, or inability to access or use, the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
IN JURISDICTIONS WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT ALLOWED, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. BECAUSE DIGIBOUQUET IS A FREE SERVICE, OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE U.S. DOLLAR (USD $1.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you in their entirety.
8. Third-Party Services
The Service uses certain third-party services to function and improve the user experience, including:
- Google Fonts — We load fonts (Quicksand and Dancing Script) from Google Fonts. Your browser may send requests to Google's servers when loading these fonts. Google's Privacy Policy applies to any data Google collects from these requests.
- Google Analytics — We use Google Analytics to understand how users interact with our website. This involves the collection of anonymized usage data including page views, session duration, and general geographic region. You can opt out of Google Analytics tracking using browser extensions or your browser's privacy settings. Google's Privacy Policy governs Google Analytics data.
- Vercel — The Service is hosted on Vercel's infrastructure. Vercel may collect certain technical data (such as IP addresses and server logs) as part of providing hosting services. Vercel's Privacy Policy governs such data.

10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. For users in the European Union, applicable EU consumer protection laws may also apply and are not affected by these Terms.
Any disputes arising out of or relating to these Terms or the Service that cannot be resolved informally should first be addressed by contacting us at the address provided below. We will make a good-faith effort to resolve any dispute through negotiation before either party pursues other remedies.
Nothing in these Terms shall limit your rights as a consumer under the mandatory laws of your country of residence. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms do not create any partnership, joint venture, employment, or agency relationship between you and DigiBouquet. You may not assign your rights or obligations under these Terms to any third party without our prior written consent. We may freely assign our rights and obligations under these Terms.
