Please read these Terms of Service carefully before using DigiBouquet. By accessing or using our website, you agree to be bound by these terms.

1. Acceptance of Terms

Welcome to DigiBouquet, accessible at https://digibouquet.net (the "Website"). These Terms of Service ("Terms") govern your access to and use of the Website and all services, features, and content offered through it (collectively, the "Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately cease using the Service. Your continued use of the Service after any modification to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed of any updates.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and DigiBouquet ("we," "us," or "our"). If you are using the Service on behalf of an organization or entity, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

DigiBouquet is a free, browser-based digital flower bouquet creation tool. The Service allows users to:

• Select from a curated collection of flower, petal, greenery, and bouquet-design visuals to compose a digital bouquet
• Choose card templates, background themes, and visual styles for their arrangement
• Personalize bouquets with custom recipient names, sender names, and free-form messages
• Generate a unique database-backed shareable URL, with optional password protection
• View bouquets created by others via shared links

The Service does not require a DigiBouquet user account. New bouquets are stored in a database and receive a random /bouquet/{shareId} link. An unprotected bouquet can be viewed by anyone with the link; a protected bouquet requires the creator's password. DigiBouquet processes the password to create or verify a salted scrypt digest and does not store the plaintext password. Created bouquets are permanent snapshots and cannot currently be edited or deleted through the Service. Legacy /bouquet#b=... links remain readable, and temporary compatibility for older /create-bouquet?b=... links ends October 30, 2026.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Acceptable Use

By using the Service, you agree to use it only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Service. You agree not to:

• Use the Service to transmit, distribute, or store content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Use the Service to create bouquets with messages that constitute hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Attempt to gain unauthorized access to any portion of the Service, its related systems, or networks connected to the Service
• Use automated scripts, bots, scrapers, or other automated means to access the Service in a manner that exceeds reasonable personal use
• Attempt to interfere with or disrupt the integrity or performance of the Service or the data contained therein
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices from any portion of the Service
• Use the Service in any manner that could damage, disable, overburden, or impair the Service or servers or networks connected to the Service
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service (except to the extent permitted by applicable law)
• Use the Service to send unsolicited communications (spam) to others
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Include secrets, financial information, health information, precise location, or other sensitive personal information in a bouquet link
• Create or share content that exploits, endangers, sexualizes, or solicits personal information from a minor

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these acceptable use provisions, including suspending or terminating their access to the Service.

4. Intellectual Property

User Content: You retain ownership of the text content (names and messages) you create through the Service. By using the Service, you grant DigiBouquet the limited rights needed to store, process, transmit, and display that content as part of creating and opening a bouquet link.

Open Source Components: The Service may incorporate open-source software components governed by their own licenses. Nothing in these Terms limits your rights under, or grants you rights that supersede, the applicable open-source license terms.

5. User-Generated Content

The Service allows you to input text content including recipient names, sender names, and personal messages ("User Content"). For new bouquets, that content is stored in DigiBouquet's database and retrieved through a random share link. Legacy fragment links keep their encoded content in the URL fragment, while legacy query links send their query to the hosting infrastructure and may be logged. You bear sole responsibility for the User Content you create and share.

By creating User Content through the Service, you represent and warrant that:

• You have all necessary rights, licenses, consents, and permissions to create and share the User Content
• Your User Content does not violate any third party's intellectual property rights, privacy rights, publicity rights, or other legal rights
• Your User Content does not contain any viruses, malware, or other harmful code
• Your User Content complies with all applicable laws and regulations

You acknowledge that anyone who receives an unprotected bouquet link may access its User Content, including names and messages. If you enable password protection, you are responsible for retaining the password and choosing who receives it; DigiBouquet cannot recover it. The built-in copy action places a labeled link and plaintext password together on the device clipboard without adding the password to the URL. Clipboard history, device synchronization, browser extensions, messaging services, or other applications may retain or process what you copy. Password protection is an access control and does not turn the Service into encrypted storage for highly sensitive information. You are responsible for deciding what to include, what to copy, and with whom to share it.

We do not monitor, review, or screen User Content created through the Service. However, we reserve the right to investigate any reported misuse of the Service and take appropriate action in accordance with these Terms.

6. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect information in connection with the Service. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

The Privacy Policy explains database-backed sharing, optional password protection, clipboard handling, legacy links, permanent retention, hosting and database providers, Google Analytics and AdSense processing, cookies, identifiers, and available privacy controls. Do not rely on a share URL or password option to protect highly sensitive information.

If you are located in the European Economic Area (EEA), United Kingdom, or other jurisdictions with data protection laws, additional rights may apply to you. Please refer to our Privacy Policy for jurisdiction-specific information.

7. Disclaimers and Limitation of Liability

Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIGIBOUQUET DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that (a) the Service will function uninterrupted, securely, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements or expectations.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIGIBOUQUET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your access to or use of, or inability to access or use, the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN JURISDICTIONS WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT ALLOWED, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. BECAUSE DIGIBOUQUET IS A FREE SERVICE, OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE U.S. DOLLAR (USD $1.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you in their entirety.

8. Third-Party Services

The Service uses third-party infrastructure and may use additional services when they are enabled, including:

• Vercel — DigiBouquet is hosted on Vercel infrastructure. Vercel may process IP addresses, URLs, request headers, and technical logs to host, secure, and deliver the site. Vercel's Privacy Notice applies to its processing.
• Supabase — New bouquet records are stored in a Supabase-hosted PostgreSQL database. Supabase may process and back up those records and related operational data to provide and secure the database service. Supabase's Privacy Policy applies to its processing.
• Google Analytics and Google AdSense — Analytics measures aggregate use across the site. Database-backed share paths are normalized to /bouquet, and query strings and URL fragments are excluded from page-view locations and referrers. Analytics storage is enabled by default outside the EEA, United Kingdom, and Switzerland; in those European regions, Google storage and personalization signals start denied until the user makes a choice through Google's certified consent management platform. AdSense is enabled on the home page, FAQ, bouquet builder, and the collection and detail pages for Guides, Flowers, and Bouquet Examples. It is not loaded on shared bouquet viewers, trust and legal pages, or error pages. Google and its partners may process cookies, web beacons, IP addresses, device information, and interaction data as described in Google's partner-sites notice and Privacy Policy.

We are not responsible for the privacy practices or content of any third-party services linked to or used by the Service. We encourage you to review the privacy policies of these third parties. The inclusion of any third-party links or services does not imply our endorsement of those third parties.

9. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make changes, we will update the "Last updated" date at the top of this page. Material changes to these Terms will be communicated by posting a prominent notice on the Website.

Your continued use of the Service after we post revised Terms signifies your acceptance of those changes. If you do not agree to the revised Terms, you should stop using the Service immediately. Because DigiBouquet does not require user registration, we cannot provide individualized notice of changes — it is your responsibility to review these Terms periodically.

If we merge with or are acquired by another company, or if our business is transferred, your use of the Service will continue to be governed by these Terms (as amended) or any successor terms published by the new owner.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. For users in the European Union, applicable EU consumer protection laws may also apply and are not affected by these Terms.

Any disputes arising out of or relating to these Terms or the Service that cannot be resolved informally should first be addressed by contacting us at the address provided below. We will make a good-faith effort to resolve any dispute through negotiation before either party pursues other remedies.

Nothing in these Terms shall limit your rights as a consumer under the mandatory laws of your country of residence. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms do not create any partnership, joint venture, employment, or agency relationship between you and DigiBouquet. You may not assign your rights or obligations under these Terms to any third party without our prior written consent. We may freely assign our rights and obligations under these Terms.
